Information on how to enter forms part of these Terms and Conditions.
Entry into this Competition deems acceptance of these Terms and Conditions.
To the extent of any inconsistency between these Terms and Conditions and any other advertisements or reference to this Competition, these Terms and Conditions prevail.
The Promoter is Top Juice Pty Ltd (ABN 64 145 706 967).
Entry is open to all Australian residents, except employees of the Promoter and STUDIOCANAL and their immediate family members, associated companies and agencies and participating outlets. Immediate family means any of the following; spouse, ex-spouse, defacto spouse, child or step child (whether natural or by adoption), parent, step parent, grandparent, step grandparent, uncle, aunt, niece, nephew, brother, sister, step brother, step sister or 1st cousin.
How to Enter
In order to enter the Competition entrants must:
Purchase a limited edition Paddington 2 cup or Paddington 2 meal from participating Top Juice stores;
Correctly answer the question “Paddington loves marmalade, which is made from what fruit?”
Filling out the entry form available from participating Top Juice stores with the entrants contact details.
Entries must include all requested contact details and material to be eligible to win. Entrants may only enter in their own name.
Each Entrant may enter the Competition once per product purchase.
Date of Competition
The Competition opens Monday 27 November 2017 00:01 AEDT.
The Competition closes Friday 5 January 2018 23:59 AEDT.
The Winner of the Competition shall be the first valid entry drawn at the Promoter’s premises on 8 January 2017 11:00 AEDT.
The winner will be notified via email and telephone. The Winner will be contacted by the email address supplied in the first instance and then by phone. The Winner shall be published by the Promoter on 12 January 2018 at www.facebook.com/TopJuiceAustralia
If the Major Prize remains unclaimed, a further draw may take place on 9 April 2018 at the same time and place as the original draw, subject to any directions from a regulatory authority. The Unclaimed Prize Draw Winner will be notified by email and telephone within two (2) business days of the draw and their name will be published at facebook.com/TopJuiceAustralia from 12 April 2018.
The Promoter’s decision regarding the Winner is final and non-negotiable. The Promoter shall not enter into any correspondence regarding the results of the Competition.
The Major Prize is a private screening of Paddington 2 for the Winner and 20 companions. The Major Prize is valued at up to $420.00.
The Major Prize is subject to availability and the Promoter may substitute a prize of equal value if necessary.
The private screening of the film ‘Paddington 2’ will be arranged directly with prize winner and STUDIO CANAL. Session times and location of the screening will be agreed upon by STUDIOCANAL and the winner and are subject to availability.
The private screening of the film ‘Paddington 2’ is anticipated to take place between February 1 – 12 March. Screening is not available after 5pm on Saturday, cinema discount days or public holidays.
STUDIOCANAL reserves the right to offer a suitable equivalent prize if it is unable to arrange a screening as above due to circumstances beyond its control.
The prizes must be taken as per the available dates. If for any reason the winner does not take part of the prize at the time specified by the Promoter, then it will be considered forfeited and no compensation will be awarded. Unless expressly stated in these terms and conditions, all other expenses, including but not limited to meals, travel, upgrades are not included and are at the discretion and responsibility of the winners and their guests.
If the Winner is under the age of 16 then they must be accompanied by a parent/guardian.
Further Terms and Conditions
The Promoter reserves the right to amend, cancel or suspend the Competition if an event beyond the control of the Promoter affects the administration, security, fairness, integrity or proper conduct of the Competition. The Promoter will disqualify any individual who has tampered with the entry process or any other aspect of this Competition.
The Promoter and its related entities and associates shall not be liable for any issues or technical malfunctions which may affect any person entering the Competition or the judging of the Competition.
Any Entrant found to be entering incorrect details or engaging in fraudulent behaviour shall be immediately disqualified. If such an entrant is awarded a prize then the Promoter may remove that Entrant as a winner. The Promoter has the sole discretion to determine if this clause has been breached and its decision in relation to this clause shall be final.
The Promoter reserves the right to request a winner sign a deed of release or any other relevant forms or agreements that the Promoter deems necessary, including to provide proof of identity or proof of residency in order to claim a prize. In the event that the winner cannot provide suitable proof the winner will forfeit the prize and no substitute will be offered.
In the event a winner is unable to satisfy these Terms and Conditions the Promoter reserves the right to choose a substitute winner.
The Promoter’s decision in relation to all aspects of the Competition is final and binding, and no correspondence shall be entered into. No responsibility is accepted for late, lost or misdirected entries.
In participating in this Competition, all entrants and winner(s) agree to participate in all editorial and promotional activities relating to the Competition, including but not limited to being interview, photographed and recorded. All entrants and winners agree to grant the Promoter a perpetual and non-exclusive licence to use such footage and photographs in all media worldwide, including all forms of online and social media. No entrant or winner shall be granted a fee for such use.
Nothing in these Terms and Conditions limit, exclude or modify or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth), as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia. Except for any liability that cannot be excluded by law, the Promoter excludes all liability for any personal injury, or any loss or damage, whether direct or indirect arising in any way out of this Competition.
Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) taking of the prize.
