Top Juice Pty Ltd (ACN 145 706 967) and Top Juice Franchising Pty Ltd (ACN 157 679 439) (collectively referred to as “Top Juice”, “we”, “us” or “our”) are committed to protecting the privacy of personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (as amended from time to time) (“Privacy Laws”).

The Privacy Policy sets out how Top Juice collects, uses, and discloses your personal information when you:

  • visit our website (https://www.topjuice.com.au/) (“Site”);
  • use the Top Juice app (“App”);
  • engage with the Feel Good Club Loyalty Program;
  • place an order via our ordering methods; or
  • otherwise engage with us and provide personal information to us by any other means, including physically or electronically,
    (collectively, the “Services”).

By using and accessing any of the Services, you agree to the collection, use, and disclosure of your information as described in this Privacy Policy.
If you do not agree to this Privacy Policy, please do not use or access any of the Services.
Please keep in mind that refusal to accept this Privacy Policy may mean that we will be unable to provide you with the requested Services.

WHAT PERSONAL INFORMATION WE COLLECT

When used in this Privacy Policy, the terms “personal information” and “sensitive information” have the meaning given to them under the Privacy Laws, and we are referring to information that identifies, relates to, describes or can be associated with you.

We only collect your personal information where that personal information is necessary for one or more of our business functions or to provide the Services.

The types of personal information we collect may vary depending on the type of interaction you have with us.

When you use our Services, the personal information we collect includes:

  • Basic Contact Details including your full name, date of birth, address, phone number and email address;
  • Account Information including your username, password, security questions, referral codes and preferences to keep your account secure;
  • Order Information including billing and shipping addresses, purchase history, order details, payment confirmations, loyalty stamps, dietary requirements, and stores you have visited;
  • Customer Support Information which covers any details you choose to share when communicating with our support team;
  • Marketing Preferences so we understand how you wish to receive marketing communications and promotional materials from us;
  • Device and Usage Data including your IP address which helps us understand how people use our Services and improve our offerings; and
  • Business-related information including company name, ABN/ACN, job title, and bank account details (where relevant for business transactions).

Some features of the Services may require you to directly provide us with certain information about yourself. You may choose not to provide this information, but doing so may prevent you from using or accessing these features.

If you do not provide us with your personal information, this may impact or restrict our ability to interact with you.

We do not collect sensitive information about you, which includes information about racial or ethnic groups or religious beliefs without your express consent or otherwise in accordance with the Privacy Laws.

HOW YOUR PERSONAL INFORMATION MAY BE COLLECTED

Your personal information may be collected by us in various ways, including, but not limited to, when you:

  • visit the Site;
  • use the App;
  • apply for a position at Top Juice;
  • apply to become a franchisee of the Top Juice franchise network;
  • engage with the Feel Good Club Loyalty Program
  • register your information on, or interest with, the Site, social media pages, the  App, or other platforms managed by us or a third party that has been engaged by us;
  • place an order via our ordering methods (which may change from time to time);
  • enter our competition or promotion, or a competition or promotion authorised by us and run by a third party;
  • subscribe to our newsletter (if any);
  • participate in a survey or feedback form;
  • contact our customer service team; and
  • contact any of our employees, contractors or officers.

HOW YOUR PERSONAL INFORMATION WILL BE USED

We collect your personal information so that we can use it for our functions and activities and provide products and services to you, which include, among other things:

  • Account Management – create and manage your Top Juice account on the App or Site;
  • Loyalty Program – operate and administer the Feel Good Club Loyalty Program, including verifying eligibility for sign-up, birthday, and referral rewards;
  • Order Processing – process, confirm and fulfill your orders made via the App or the Site, processing a refund of an order and verifying your nominated electronic payment method;
  • Customer Service – provide customer service support by responding to feedback, complaints and enquiries, as well as send important service updates and transactional information;
  • Marketing Communications – keep you informed about marketing initiatives, including direct marketing campaigns, promotions, events, new products, store openings, newsletters and updates;
  • Recruitment – process and manage employment;
  • Service and Site Improvement – to recognise the device you use, collect insights on your experience and adapt our Services to better meet your personal requirements;
  • Internal business operations – facilitating our internal business operations, including fulfillment of any legal and regulatory requirements;
  • Promotions – conducting and allowing you to participate in a promotion, competition or promotional activity;
  • Franchising – providing information that you request about our franchises and processing and considering your franchise application and conducting record checks;
  • Research and insights – to conduct product and market research, and to understand your preferences, patterns, interests and behaviours;
  • Product development – for the administrative, planning, product or service development, quality control and research purposes; and
  • Communications – communicating with you, including in relation to offers, promotions, new products and store openings.

We may also use your personal information for other purposes not listed above which will be made clear to you at the time we collect your personal information, or for such purposes as may be required or permitted by law.

COOKIES AND WEB BEACONS

We use cookies, web beacons, and similar technologies on the Site and App to identify specific devices in order to collect aggregate information on how visitors are experiencing the Site or App. This information will help to better adapt the Site and App to suit personal requirements.

Most browsers automatically accept cookies by default, but you can choose to set your browser to remove or reject cookies through your browser controls. Please keep in mind that removing or blocking cookies can negatively impact your user experience and may cause some of the Services, including certain features and general functionality, to work incorrectly or no longer be available. Additionally, blocking cookies may not completely prevent how we share information with third parties such as our service providers.

Cookies allow a computer device to be identified, but they do not permit any reference to a specific individual.

MARKETING COMMUNICATIONS

Where you have consented, we and our related entities will use your personal information from time to time to contact you (including via SMS, email, push notifications, telephone or online) to let you know about news, special offers, products and services that you might be interested in (Marketing Communications).

You may opt out at any time by following the instructions in the marketing communications, adjusting your preferences on the App, or otherwise contact us directly via the contact details in the “CONTACT” section below.

Please note that if you opt out, we may still send you non-promotional messages such as receipts or information about your account.

DISCLOSURE OF INFORMATION TO THIRD PARTIES

We may disclose personal information we collect from you.

The types of persons and organisations to whom we may disclose your personal information includes:

  • our employees, related entities, suppliers, consultants, contractors or agents:
    • for the purposes set out in the section above entitled “HOW YOUR PERSONAL INFORMATION WILL BE USED” or for other purposes directly related to the purpose for which the personal information is collected; and
    • to help us provide and market our products to you;
  • suppliers and other third parties for the purposes of operation of the Site, App and our business, including web hosting service providers, IT systems administrators, electronic payment processors, data entrants, debt collection agents and electronic network administrators;
  • professional advisors (such as accountants, solicitors, business advisors and consultants); and
  • nominated third parties you have consented to.

ONLINE CATERING ORDERS

When you place an online catering order through our Site, we may collect the following personal information:

  • your full name, contact number, email address, and pickup location;
  • details of your catering order, including dietary requirements;
  • payment details (processed securely through third-party payment processors); and
  • any special instructions or notes provided.

We may disclose your order and contact details to internal teams or trusted delivery providers to facilitate fulfilment.

WHERE YOUR PERSONAL INFORMATION IS STORED

Your personal information may be held on electronic or hard copy form and may be stored by us or by a third party that we have engaged to store your personal information. Where we store your personal information depends on what interaction you have had with us and how we use your personal information.

SECURITY AND RETENTION OF YOUR INFORMATION

We take reasonable steps to protect your personal information from misuse or unauthorised disclosure by limiting access where appropriate.

OVERSEAS DISCLOSURE

We may disclose personal information to our third-party suppliers and service providers located outside of Australia for some of the purposes listed above.  This may involve disclosure to countries including, without limitation, the United States of America.

By providing us with your personal information, you consent to the transfer of your personal information overseas.

LINKS TO OTHER SITES

When you are on our App or Site, you may be directed to other sites that our beyond our control. If you visit one of these linked websites, you should review their privacy and other policies. A link to a third-party website is not an endorsement by us as to the accuracy or trustworthiness of that website or any contents and information collected, and we are not responsible for the policies and practices of those third-party websites.

ACCESS TO PERSONAL INFORMATION AND CORRECTION

Under the Privacy Laws, you have rights to access and correct personal information that we hold about you.

You may request access to the personal information and seek correction of same by contacting us via the contact details below.

There may be instances where we cannot grant you access to the personal information that we hold about you, for example, if it would result in a breach of confidentiality or would interfere with the privacy of others.

We may charge a reasonable administration fee to cover the costs of meeting your request.

Where we receive a request to access or correct the personal information, we will take reasonable steps to respond to such requests within a reasonable period of time.

FRANCHISE APPLICATIONS

Generally, when you apply to become a franchisee of the Top Juice franchise system, we, or a third party engaged by us, will collect and store the type of information reasonably required by us to assess your franchise application.

In considering your application, we may also obtain personal information about you from third parties, for example, from your previous employers or nominated referees. Subject to your consent, we may also collect sensitive information about you such as information about any criminal record you may have or your membership of any professional or trade association.

We may collect, store and share your personal information for any one or more of the following purposes:

  • assessing your application to become a Top Juice franchisee;
  • assessing whether you (and the directors and operators for a potential franchised business) are suitable to progress to each stage of the Top Juice franchise recruitment process;
  • for future Top Juice franchise opportunities; and
  • if required under a legislative instrument, such as the Franchising Code of Conduct.

EMPLOYMENT APPLICATIONS

Generally, when you apply for a position with us through our Site, a third-party website, or a recruitment agency, we will collect and store the type of personal information we reasonably require to assess your job application.

Depending on the position that you are applying for, we may collect and store some or all of the following information (without limitation) from you:

  • full name;
  • gender;
  • date of birth and/or age;
  • postal address;
  • telephone number and email address;
  • education details;
  • employment history and other information relating to your work experience;
  • information that would enable us to identify you and your work entitlements in Australia, such as your driver’s licence or passport details; and
  • references (it is your responsibility that you provide us with contact details of people who have been provider their express consent to you for their personal information to be included in your employment application).

In considering your application, we may also obtain personal information about you from third parties, for example, from your previous employers or nominated referees. Subject to your consent, we may also collect sensitive information about you such as information about your health (including any disability) or any criminal record you may have.

We may, unless you tell us otherwise, store your personal information for future employment opportunities.

We may disclose your information to:

  • your referees or previous employers;
  • recruitment agencies or agencies or contractors acting on our behalf;
  • our related entities;
  • law enforcement agencies to verify whether you have a criminal record;
  • educational organisations to the extent necessary to verify your qualifications; and
  • other government bodies for the purposes of assessing your working rights in Australia and your driving record.

CHANGES TO THIS PRIVACY POLICY

We may modify or update this Privacy Policy from time to time, including to reflect changes to our practices or for other operational, legal, or regulatory reasons.

We will post the revised Privacy Policy on our Site, update the “Last Updated” date and take any other steps required by Privacy Laws.
